Foreclosure is a process the bank uses to get back the collateral on its loan/your home.

Foreclosure does not happen overnight. It is a process that usually begins after two or three months of missed mortgage payments. Because the bank wants the money and not the property, it will schedule the sale of your home after just four to five months of missed payments.

There are certain steps the bank will take before foreclosing. First, you should receive a letter from the mortgage company's attorney indicating the amount due, broken into categories for principal, interest and late fees. Next, a notice will be published in the local newspaper announcing the upcoming Sheriff's sale of your home. This notice will be published for four to five weeks on the same day each week until the sale date. You may also receive a notice taped to your door of the foreclosure and sale of your home.

Bankruptcy temporarily stops foreclosure until arrangements can be made.

Taking action and contacting a lawyer earlier rather than later in the foreclosure process is advisable. By filing for bankruptcy before the sale, an automatic stay goes into effect that temporarily stops the foreclosure. Depending on the type of bankruptcy and the terms, you may receive a six-month to 12-month redemption period in which you can pay off your mortgage balance or refinance your loan.
